Terms of Service

These Terms of Service ("Terms") govern your use of Thryvest, LLC's website at thryvest.com and personal finance application (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About Thryvest

Thryvest is a personal finance management tool that connects to your financial accounts via Plaid to analyze your cash flow, identify idle funds, and provide recommendations to help you save more and pay down debt faster. Thryvest is a software service, not a licensed financial advisor, broker, or money transmitter.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using Thryvest, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Account Registration

You must create an account to use Thryvest. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@thryvest.com if you suspect unauthorized access to your account.

4. Bank Account Connection

Thryvest uses Plaid Technologies, Inc. to securely connect to your financial institutions. By connecting your accounts, you authorize Thryvest and Plaid to access your account information including balances, transactions, and account details. Your use of Plaid is also subject to Plaid's End User Privacy Policy. We never receive or store your bank login credentials.

5. Subscription and Payment

Thryvest offers a paid subscription at $9.99 per month. Payment is processed securely through Stripe. Your subscription will automatically renew each month unless you cancel. You may cancel at any time through your account settings. No refunds are provided for partial billing periods.

6. Not Financial Advice

The recommendations, insights, and information provided by Thryvest are for informational purposes only and do not constitute financial, investment, legal, or tax advice. Thryvest is not a registered investment advisor. You should consult a qualified financial professional before making significant financial decisions. Thryvest makes no guarantees about the accuracy of financial recommendations or outcomes.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials with any third party
• Use the Service to transmit any harmful, fraudulent, or misleading content
• Reverse engineer, decompile, or attempt to extract source code from the Service

8. Intellectual Property

All content, features, and functionality of the Service including but not limited to text, graphics, logos, and software are the exclusive property of Thryvest, LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THRYVEST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRYVEST, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting support@thryvest.com. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of New Castle County, Delaware.
